Catawiki Live Giveaway Seller Policy

You can organise promotional giveaways during Catawiki Live if you comply with these rules.

This policy applies in addition to our Terms of Use, including Seller Terms. If there is a conflict, the rules in this  giveaway policy rules apply and take precedence in respect of the giveaway and giveaway functionality only.


What are giveaways?

Giveaways are promotional activities designed to promote your livestream and related objects. Giveaways may not be used as, or presented as, a form of gambling.

This means that you are not allowed to:

  • ask users to pay any fee or charge them any amounts to take part in a giveaway
  • present a giveaway as a fixed or standard offer
  • organise a giveaway that is not linked to a specific livestream
  • direct users to an external gambling platform, your own website or any other external environment as part of the giveaway
  • use the giveaway to pressure users into bidding or to create artificial urgency

Each giveaway must be announced separately and clearly as part of a livestream. Catawiki may also promote the relevant giveaway on its platform or through other Catawiki channels. 


Types of giveaway

You may organise:

  • a chance-based giveaway, where one or more winners are selected at random, such as through “spin of the wheel”. You can only organise these giveaways when we make an approved winner-selection environment available to you.
  • a giveaway without an element of chance, where every user who meets clearly defined conditions receives the same prize. For example, the first ten users to place a bid or everyone who posts a specified message in the livestream chat.


Your role as the organiser

You organise and remain fully responsible for the giveaway. We only provide the online marketplace and livestream environment.

As such, you must not state or suggest that:

  • Catawiki organises the giveaway
  • Catawiki is responsible for delivering the giveaway objects
  • Catawiki selects or determines the winners
  • Catawiki is responsible for handling questions, claims or disputes about the giveaway.


Voucher campaigns organised by us

We may occasionally organise a temporary voucher campaign as part of a Catawiki Live. We will tell you clearly in advance when this is the case. We may ask you to present or promote the campaign during your livestream.

In such cases, you act only as the presenter of the voucher campaign and do not become its co-organiser by promoting it in line with our instructions.


Explain the rules before users take part

Before the giveaway starts, clearly explain:

  • the prize or prizes
  • the number of prizes available
  • what users need to do to take part
  • whether winners are selected by chance or whether everyone who meets the conditions receives a prize
  • when and how winners will be announced
  • that you, and not we, organise the giveaway.


Communication 

Your communication, including that of any co-hosts, must be clear, accurate and complete. You must not:

  • overstate a giveaway’s value or rarity
  • misrepresent the prize or the chance of winning
  • leave out important participation or delivery conditions
  • give false or unclear participation conditions
  • pressure users, create artificial urgency or unfairly influence bidding
  • suggest that we organise the giveaway, select winners or deliver prizes.

Answer questions about the giveaway truthfully and completely.


Select winners fairly

For giveaways without an element of chance, apply the conditions exactly as announced. For example, if you state that the first ten users to place a bid receive a prize, you must award prizes only to those ten users.

For chance-based giveaways, winner selection must be fair, transparent and impartial. You must not influence or manipulate the result.

Only use winner-selection tools or methods that we make available or approve for Catawiki Live. Do not select winners on an external platform, website or tool.

Keep a clear record of:

  • the announced rules
  • the winner-selection method
  • the winners.

We may ask you to provide this record.


Contacting winners and delivering the giveaway objects 

You are also responsible for shipping and delivery costs, except for voucher campaigns where we provide a digital voucher. This includes:

  • Arranging the contract with the shipping company
  • Packaging and preparing the prize carefully
  • Contacting the shipping company if a delivery issue occurs
  • Ensuring the giveaway object arrives in good condition
  • Ship the giveaway object  within five days of announcing the winners.

You are responsible for all shipping costs. If a giveaway winner has also won an object in the Catawiki Live, you must cover any giveaway shipping cost above the standard shipping cost charged for that object. You cannot charge this additional cost to the giveaway winner.


Prize value and eligible objects

The total value of all prizes in one giveaway must not exceed €250, unless you have received our written permission in advance. You must ensure that the stated value of each prize is accurate and not misleading.

Every giveaway object must:

  • Be yours to offer and transfer
  • Respect intellectual property rights and other third-party rights
  • Comply with our prohibited and restricted objects policy
  • Be lawful to ship to the winner

You cannot offer age-restricted objects, including alcohol, tobacco or objects containing nudity.


Legal and tax obligations

As the giveaway organiser, you are responsible for complying with all applicable laws and regulations, including any rules on promotional games of chance and applicable tax obligations.


Questions, complaints and disputes

You are responsible for handling questions, complaints, claims and disputes relating to your giveaway. This includes disputes about:

  • the giveaway rules
  • participation
  • the giveaway object
  • delivery

We are not responsible for a specific giveaway, the relevant giveaway  object, winner selection, delivery or any related dispute. We may choose to review or help resolve an issue, but this does not mean that we accept responsibility or become (co-) organiser of the related giveaway.


If you do not follow these rules

If you organise a giveaway without following, and taking account of, the rules set out in this policy, we may take action. This may include:

  • interrupting or suspending a livestream
  • restricting or disabling chat
  • removing content
  • limiting or suspending access to Catawiki Live
  • stopping or cancelling a giveaway
  • taking enforcement measures under our Terms of Use


Changes to giveaway functionality

Giveaway functionality may change, be restricted, suspended or discontinued at any time. Taking part in giveaways does not give you a right to continued access. You must follow any instructions or restrictions we communicate about giveaways.
