The distinction between art and pornography is one that the law has struggled with for centuries. There is still an overlap between art and pornography that makes it difficult to easily distinguish between them. Art invites the viewer to appreciate the work as more than just a physiological response. Art is clearly aimed at aesthetic experience while pornography is solely concerned with sexual arousal. The two are incompatible.

Ultimately it is the viewer and not the judiciary who determines whether something is artistic or pornographic. As always it is the viewer who completes & validates the labours of the artist.
